# Information & Disclosure Guide

## Important Information About Your Quote

We have prepared this information to help you understand how your insurance quote has been developed and your obligations under New Zealand insurance law. At Emerre & Hathaway Insurance Brokers, we want you to feel confident and informed about your insurance options. The details below explain your responsibilities, how insurers assess risk, and the disclosures we are required to make. Taking a few minutes to read through this helps ensure your cover is accurate, fair, and fully compliant.

## Your Duty of Disclosure

When applying for insurance, you have a legal duty of disclosure under the Insurance Contracts Act and the Financial Markets Conduct Act 2013 (FMCA).

You must tell us anything that could influence an insurer's decision to insure you or the terms they apply.

### Examples of material facts include:

- Disclosing previous insurance history: Notify us if you ever had any insurance declined, cancelled, renewal refused, special terms imposed, or a claim declined.
- Non-standard property construction (e.g. flat roofs, monolithic cladding)
- Flooding, erosion, landslip or subsidence on or near your property
- Council hazard or land-category notices
- Business activity at home or on the property
- Vehicle modifications or performance upgrades
- Any criminal convictions or driving offences (if relevant)
- Areas of your house that are not consented

**Failure to disclose these details may result in your policy being cancelled or a claim being declined.**

All information you provide is treated confidentially and used solely to assess your insurance needs.

## Property & Land Risk Disclosure

Insurers now review property risk based on council-issued land categorisation, and other risk based management systems.

If your home or section has been assigned a hazard category (for example, flood, slip, inundation, subsidence, or erosion risk), this is a material fact and must be disclosed.

You can check your Record of Title and any hazard entries using the official LINZ portal:

Your quotation is based on your property not being categorised as at risk from natural hazards and no notations being recorded on the Record of Title.

## Sum Insured Responsibility

The onus is on the homeowner to ensure the sum insured is sufficient.

The house sum insured should cover the cost of:

- Demolishing the existing structure
- Removing debris
- Obtaining council consents
- Paying professional fees (architects, engineers, etc.)
- Rebuilding the house and any outbuildings to their original size and standard prior to loss

While we can provide general guidance to help you assess your sum insured, this is only a guide and we cannot be responsible for its accuracy.
